I agree. I should create an FAQ page, because this is a complex topic. Regarding your question, copyright is territorial. Following your example, until a few years ago the copyright term in Uruguay was 50 years post mortem. Several Uruguayan publishers published books by foreign authors who died more than 50 years ago but less than 70 years ago. They did so without paying royalties because they followed Uruguayan law. They could only sell those books in Uruguay. They could not sell them in other countries. If they sent them to countries with a 70-year term, they had to pay royalties or it was illegal. Another example is wikilivres.org, hosted in New Zealand. NZ's law has a 50-year term. Therefore, books by authors who died more than 50 years ago can be published there. Since the Internet is global, texts can be accessed from other countries where the term is higher. But I know they received complaints from some other countries and that they have had to block access based on user's IP. 4 weeks ago |

I had no idea that is how it worked. Sorry about that. Maybe it could be explained somewhere. I know enough to know CC0 is not the same as public domain, and it seems right there some misconceptions could be ruled out. As for 50 vs 70. Lets say I have a nation of the default 50, and I sell you the work of your own contryman who past death is counting down from 70, it gets stopped at the border of your country presumably, or is it illegal for you to purchase it at all? Am I free to sell it to you within your country? Is it possible to buy/get digital copies legally from a 50-year country as some sort of loophole? 4 weeks ago |
